I really miss Keith Olbermann, and he surely would be useful in the coming political season. But one of the things I miss from his old show on MSNBC (besides Worst Person in the World) is his continuing count of the days after W Bush announced ‘Mission Accomplished‘ in Iraq.
But we don’t have Keith around right now. So I’m inaugurating a new countdown. On July 26, Senator Harry Reid told a Huffington Post reporter that a Bain Capital investor had told him that Mitt Romney hadn’t paid income taxes in ten years. Mitt Romney has so far not released even one full year of his tax returns (Per this article in Forbes, his 2010 returns do not contain the FBAR filings required for someone who has overseas accounts).
In a trial, the unwillingness of the defendant to release evidence that could exculpate them would be considered under the judge’s rules of the Missing Evidence instruction.
At law, if a person is control of evidence refuses to produce the evidence, then the jury is instructed that there is a presumption that the evidence would be against the party failing to produce. It is called the “Missing Evidence” instruction.
